Institutional licensing terms, software usage rights, and operating principles governing Stark CBT deployments.
Agreement Overview
By downloading, installing, purchasing, or executing the Stark CBT software platform (including the cbt-server binary, teacher control panel, and Stark CBT Student Exam App), your school, college, or examination center agrees to be bound by the terms and conditions outlined below.
1. Institutional Licensing Grant
Upon purchase of a Termly, Annual Session, or Perpetual Lifetime License, XpanSieve Studio grants your educational institution a non-exclusive, non-transferable license to install, operate, and execute Stark CBT across your school’s designated local area network (LAN) up to your licensed student capacity.
2. Offline Activation & Machine Binding
Each license key is issued to a specific school computer server based on cryptographic hardware fingerprinting. Keys must not be shared, duplicated, publically published, or transferred to unverified third-party machines without prior authorization from XpanSieve Studio.
3. Machine Transfer & Hardware Upgrades
In the event that an educational institution upgrades or replaces its primary examination server PC, XpanSieve Studio provides license migration and key re-issuance at no additional fee upon verification of institutional ownership.
4. Student Capacity & Tier Limits
Licenses are categorized strictly by registered student enrollment capacity (100, 200, 500, 1,000, or custom enterprise volumes). All license tiers possess identical application feature sets. Operating Stark CBT for student volumes substantially exceeding your registered tier capacity requires an authorized tier upgrade.
5. Lifetime License Maintenance & Future Releases
A Lifetime License grants permanent ownership of the purchased version of Stark CBT with zero recurring software fees. It includes 12 calendar months of complimentary maintenance updates, security patches, and priority technical support from the date of issuance. Continued priority technical support and major future version upgrades after the initial 12-month period may be renewed separately.
6. Intellectual Property & Anti-Piracy
Stark CBT, its compiled binary distributions, proprietary question bank encryptions, control panel interfaces, logos, and documentation are the exclusive intellectual property of XpanSieve Studio. Licensees shall not decompile, reverse-engineer, disassemble, modify, or create derivative works of the binary files, nor attempt to bypass offline key verification algorithms.
7. School Operational Responsibility
While Stark CBT provides resilient offline examination features including automatic state recovery, immediate transaction commits, and anti-malpractice detection, the licensee school remains responsible for maintaining functional computer lab electrical power (e.g., generator or UPS backup), local network cabling integrity, and routine backup exports to external storage media.
8. Limitation of Liability
To the maximum extent permitted under Nigerian law, XpanSieve Studio shall not be liable for indirect, incidental, special, or consequential damages resulting from local computer lab hardware failures, local power cuts, physical tampering, or student network interference occurring outside the controlled software environment.
9. Governing Law & Dispute Resolution
These Terms of Service and Software Licensing Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising hereunder shall first be submitted to mutual amicable resolution or mediation before the courts of the Federal Republic of Nigeria.
